E&O Insurance for Consultants: What It Covers and Costs

Errors and omissions (E&O) insurance for consultants pays your legal defense and covered damages when a client claims your advice, recommendation or work caused them a financial loss. General liability doesn't cover that kind of claim, because it only covers injuries to people or damage to property. E&O can be relatively inexpensive for small consulting firms. For example, Hiscox's professional liability starts at $270 a year with no minimum earned premium, and LIO's E&O minimum premiums start as low as $500.[1][2]

This guide is for a consultant or small consulting firm, whether in management, IT, marketing, HR or another specialty, that has been asked for proof of E&O in a client contract or would like protection before a dispute. It covers what an E&O policy pays for, how claims-made coverage works, what it costs, which programs write consultants and what to check in the contract. What does E&O insurance cover for a consultant?

Claims that you performed your professional services negligently. The Hiscox professional liability flyer describes it as protection for clients "sued for negligence in performing professional services, even if they haven't made a mistake," covering both the cost of legal defense and any settlement or judgment.[3] Typical consulting claims:

  • A system you recommended failed to do what was promised and the client lost revenue.
  • A missed deadline in your deliverable delayed the client's launch.
  • A strategy or financial model contained an error the client relied on.
  • A marketing campaign used material that led to a copyright claim.

Hiscox's policy also covers work done by your employees, temporary staff and independent contractors, claims about work done anywhere in the world if the claim is brought in the US, and $200,000 of copyright infringement cover for most marketing and design classes.[1][3]

What it doesn't cover: bodily injury and property damage (general liability), a data breach at your firm (cyber), and intentional wrongdoing. In California, "an insurer is not liable for a loss caused by the wilful act of the insured," though negligence stays covered.[4]

How does claims-made E&O coverage work?

Almost all consultant E&O is issued on a claims-made basis. The policy in effect when a claim is first made will respond, provided the work was done after the policy's retroactive date. There are two consequences:

  1. Keep coverage continuous. If you let the policy lapse, a claim made later about work you did while insured may not be covered by anything.
  2. Protect your retroactive date. When you change insurers, the new policy should keep your original retroactive date. Hiscox states that its retroactive date equals the existing policy's when you switch.[1]

Above the floor, the price depends on your specialty, your revenue, the policy limit, the deductible, the contracts you have with your clients and any past claims. We don't publish a typical consultant premium, because the spread between specialties is too wide to fit into one figure.

Defense outside the limit is worth asking for. On LIO's form, defense costs don't reduce the limit available for damages.[2]

What should I check in a client's insurance requirement?

The contract's insurance clause tells you what to buy. Look for:

  • The limit, per claim and aggregate. $1 million and $2 million are common requests.
  • Claims-made acceptance, and whether the client requires coverage to continue for some years after the contract ends.
  • Additional insured status, which some clients request even on E&O. Hiscox includes blanket additional insured at no charge for most classes.[3]
  • Indemnity wording. A broad hold harmless clause can make you liable for more than your negligence, and insurance may not follow. Our guide to the hold harmless agreement explains the types.

Generally no. Most consultants buy it because clients require it in contracts, or to pay defense costs if a client claims a loss.

Does E&O cover claims from work I did before buying the policy?

Only back to the policy's retroactive date. With full prior acts, as LIO offers, earlier work is included, subject to the policy's terms.[2]
