Landscaping Insurance in California: Licenses and Pesticides

California landscapers who apply any pesticide need a DPR license with proof of liability cover. What insurance you need and which programs take tree work.

A California landscaping company needs general liability, workers' comp for any employee, and coverage for mowers, tools and trailers. Depending on the type of work, your business may need more. For example, landscape construction over $1,000 requires a CSLB license, tree work beyond incidental pruning of small trees is contractor work, and applying any pesticide, "even if it is only incidental to other maintenance gardening tasks," requires a Department of Pesticide Regulation (DPR) maintenance gardener license and county registration.[1][2][3] Landscaping is a standard class for general liability, but programs have restrictions on tree removal, heavy pesticide spraying and snow work.[4][5]

This guide is for a California landscaper, gardener or lawn care service, from a solo maintenance route to a C-27 landscape contractor. It covers which licenses bring which insurance requirements, what the DPR asks for, which programs accept landscaping and where they draw lines, and what sets your price. Which licenses and insurance rules apply to a California landscaper?

It depends on what you do. The table sorts common landscaping work by the rule it triggers:

From January 1, 2028, the CSLB's no-employee workers' comp exemption ends for almost every licensee, including C-27.[7]

What insurance does the DPR require for a maintenance gardener license?

Proof of financial responsibility, renewed each year. The DPR's license package gives four options, and the insurance option must meet at least these minimums:[6]

The coverage must include chemical liability.[6] That is the catch: some general liability policies exclude or limit pesticide and herbicide claims, so tell your broker you use chemicals and ask for a certificate the DPR will accept. The license itself costs $180 per calendar year, and the business needs a qualified applicator holding the maintenance gardener (Q) or landscape maintenance (B) category.[6]

Which insurers write landscaping businesses in California?

Landscaping is a standard class for most contractor programs, but each sets limits on tree and chemical work:

A landscaper whose main business is tree removal, or who sprays heavily, usually needs a program that writes tree service or a surplus lines market.

How much does landscaping insurance cost?

The published floors are low, and the work mix sets the rest. Hiscox general liability starts at $350 a year, with a minimum earned premium for landscape classes, and Blitz's contractor general liability starts at $500 plus taxes and fees.[15][13]

What moves the price:

  1. Tree work. Height, removal versus trimming, and the share of revenue.
  2. Chemical application. Pesticide and herbicide work raises the price and narrows the market.[5]
  3. Construction versus maintenance. Hardscape, grading and irrigation installation rate higher than mowing.
  4. Payroll. Workers' comp is rated on your crew's payroll in the landscape gardening class. The state's average advisory rate across all classes is $1.65 per $100 of payroll.[16]
  5. Snow and ice work, where offered, which some programs cap.[4]

What about mowers, tools and trailers?

General liability doesn't cover your own equipment. A landscaper needs:

  • Inland marine or contractors equipment for mowers, blowers, trimmers and small tools on trucks and at job sites. MGT includes contractors' tools and equipment in its BOP with limits from $5,000 to $100,000.[11]

Frequently asked questions

Do gardeners need a license in California?

Not from the CSLB for maintenance jobs under $1,000 with no permit.[1] Any gardener who applies pesticides, even incidentally, needs a DPR maintenance gardener pest control business license and county registration.[3]

How much liability insurance does the DPR require for a maintenance gardener?

At least $5,000 bodily injury per person, $10,000 per occurrence and $5,000 property damage, including chemical liability, or a $5,000 bond or certificate of deposit.[6]

Can a gardener trim trees without a license?

A gardener may do incidental pruning of trees under 15 feet as part of routine work. Other tree removal, pruning, stump removal, cabling or guying is contractor work.[2]

Does general liability cover pesticide damage?

Not always. Some policies exclude or limit chemical claims, and the DPR requires coverage that includes chemical liability. Tell your broker about any spraying.[6]
